Itʼs Not My Fault! The Looming Danger of Space Debris and the Quest Towards a Future International Legal Framework
Abstract
The predominant approach for research on space debris over the years has been the interpretation and sufficiency of current regulations and policies to outer space policy propositions based on normative standards, or a blend of both. Indeed, several spacefaring nations have started to evaluate the efficiency of their domestic outer space laws to reduce debris in their use and exploration of outer space, but like many other subjects of outer space law, perhaps interpretation-based research continues to predominate policy-based research. A comprehension of this demarcation is necessary to consider the future scope, structure and direction of legal research on space debris. This chapter provides an overview of the emergence of space debris as a phenomenon and how state and space companies have approached its management and mitigation. It will also evaluate the evolution of the regulation of space debris under outer space law to identify avenues for future research in the area.
